Terms of Service

These terms form the agreement between you and the developer of Xpiry when you install or use the Xpiry Android app or this website. Please read them — section 14 limits the developer's liability, and section 8 explains why you should not rely on Xpiry alone for critical dates.

1. Acceptance of terms

By downloading, installing or using Xpiry ("the app"), or by using xpiry.net ("the website"), you agree to these Terms of Service and to the Privacy Policy, which forms part of this agreement. If you do not agree, do not use the app, and uninstall it if it is already installed.

Xpiry is distributed through Google Play, so Google's Play Terms of Service also apply to your download. Where Google's terms conflict with these terms in respect of distribution or payment, Google's terms prevail for those matters.

2. The service

Xpiry is an Android application for tracking expiration dates and managing simple inventory. It lets you record products with expiration dates, quantities, categories, shelf places, notes, photos and module-specific fields; receive local reminders before products expire; keep a history of consumed and expired products; export your list to PDF, CSV or Excel; scan barcodes to help fill in product details; and optionally back your data up to your own Google Drive account.

Xpiry is a personal organisational tool. It is provided as-is, for your own record-keeping, and it is not a professional, medical, pharmaceutical, nutritional, food-safety, regulatory or legal compliance system.

3. Eligibility

You must be old enough to form a binding contract in your country, and to have a Google account under Google's own age rules, to use Xpiry. If you are using Xpiry on behalf of a business, you confirm you are authorised to accept these terms for that business.

4. Your responsibilities

  • Accuracy of your data. You enter the products and dates. Xpiry cannot verify them, and reminders are only as correct as the dates you record.
  • Device settings. Reminders are local notifications scheduled by Android. They depend on notification permission being granted, and can be delayed or suppressed by battery optimisation, power-saving modes, "do not disturb", force-stopping the app, or device restrictions imposed by your manufacturer. Keeping those settings workable is your responsibility.
  • Your device. You are responsible for your device, its security and its access codes. Anyone who can unlock your device can read your Xpiry data.
  • Independent verification. For anything with real consequences — medicines, infant food, allergens, legal or insurance deadlines — check the physical label or document. Do not rely on Xpiry alone.

5. Google account functionality

Xpiry does not have accounts of its own: there is no registration, no username and no password. You can use the entire app without signing in to anything.

A Google account is used for exactly one optional feature — cloud backup. When you enable it, Android asks you to pick an account and grant Xpiry access to its own application data folder in your Google Drive (drive.appdata). Xpiry requests no profile information and does not store your name or email address. You may withdraw that permission at any time from your Google Account's third-party access settings; the rest of the app continues to work.

Your use of Google's services remains subject to your agreement with Google. You are responsible for keeping your Google account secure.

6. Cloud backup

  • Cloud backup is optional and is disabled until you enable it.
  • When enabled, Xpiry writes a backup file and your product images into the Xpiry application data folder of your Google Drive. There is no Xpiry-operated server holding your data.
  • Backup files count toward your own Google Drive storage quota. If your Drive is full, or your account is suspended by Google, backups may fail.
  • Restoring is an action you start. Restoring writes the backed-up products, history and settings into the app on that device.
  • Backup requires network access and a working Google authorisation; features that need connectivity are unavailable offline.

7. Ownership of your data

Your data is yours. The products, dates, quantities, notes and photos you enter belong to you. The developer of Xpiry claims no ownership of them, acquires no licence to use them, and has no access to them: they live on your device and, if you enable backup, in your own Google Drive.

You can export your data at any time to PDF, CSV or Excel from within the app, and you can delete it at any time by deleting products, clearing the app's storage, uninstalling the app, or deleting Xpiry's hidden app data in Google Drive.

8. Backup limitations and your responsibility for important data

Keep your own copy of anything you cannot afford to lose. Cloud backup is a convenience feature, not a guaranteed archival service.

Backups can fail or be incomplete for reasons outside the developer's control, including: no network connection, a full or suspended Google Drive account, permission being revoked, Google API changes or outages, Android background restrictions preventing a scheduled backup from running, an app or operating system update, or device loss before the next backup completed. A backup reflects the moment it ran, so changes made afterwards may not be included.

You are responsible for maintaining your own copies of important information — for example by exporting to CSV, Excel or PDF and storing that file somewhere you control. To the fullest extent permitted by law, the developer is not liable for lost, corrupted, incomplete or unrestorable data.

9. Acceptable use

You agree not to:

  • use Xpiry for any unlawful purpose, or to store content that is unlawful to possess;
  • reverse engineer, decompile or attempt to derive source code from the app, except to the extent that applicable law expressly permits it;
  • modify, redistribute, resell, sublicense or republish the app or its assets, or distribute modified builds of it;
  • attempt to interfere with, disable or circumvent the ad display, purchase verification or licence checks in the app;
  • abuse the third-party services the app relies on — for example by sending automated or excessive requests to the barcode-lookup database through the app;
  • use the app to build a competing product, or to scrape data from the services it connects to;
  • submit unlawful, abusive or personal-data-laden content through the in-app feedback field.

10. Ads, purchases and subscriptions

  • Xpiry is free to download and use. The free version displays advertising, which funds its development.
  • Xpiry offers an in-app purchase and a subscription that remove ads. All payments, renewals, price changes, cancellations and refunds are handled by Google Play under Google's terms and refund policy — the developer cannot process payments or issue refunds directly.
  • Subscriptions renew automatically until cancelled. You can manage or cancel them in the Google Play Store under Payments & subscriptions.
  • If you are a consumer in the European Union, your statutory withdrawal and consumer rights apply and are not limited by these terms.
  • Removing ads changes only advertising. It does not change how your data is handled.

11. Intellectual property

The app, the Xpiry name, its icon, its interface design, its text and this website are the property of the developer and are protected by copyright and other intellectual property laws. You receive a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the app per device you own or control, for your own personal or internal business use, subject to these terms. No other rights are granted.

Third-party names and marks — Google, Google Play, Google Drive, Android, Open Food Facts, Meta — belong to their respective owners and are used only to identify those services. Xpiry is not endorsed by or affiliated with them.

12. Third-party services

Xpiry relies on external services to provide certain features: Google Play services and Google Drive for authorisation and backup, Open Food Facts for barcode product lookups, Firebase for analytics and remote configuration, Google AdMob and the Meta Audience Network for advertising, and Google Play Billing for purchases. They are listed in full in section 14 of the Privacy Policy.

These services are operated by third parties under their own terms and privacy policies. The developer does not control them and is not responsible for their availability, accuracy or content — including product information returned from a barcode lookup, which comes from a community-maintained database and may be incomplete or wrong. Features that depend on a third-party service may stop working if that service changes or shuts down.

13. Disclaimer of warranties

To the fullest extent permitted by law, Xpiry is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.

In particular, the developer does not warrant that:

  • the app will be uninterrupted, error-free or free of defects;
  • every notification will be delivered, or delivered on time — Android may delay or suppress local notifications;
  • expiration information, product data from barcode lookups, or statistics shown in the app are accurate or complete;
  • backups will always succeed, or that a backup will always be restorable;
  • the app is suitable for regulated, medical, pharmaceutical or food-safety compliance purposes.

Nothing in these terms excludes or limits any warranty or right that cannot be excluded or limited under the mandatory consumer law that applies to you. If you are an EU consumer, your statutory rights regarding conformity of digital content remain fully intact.

14. Limitation of liability

To the fullest extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, loss of profits, loss of goodwill, business interruption, spoiled or wasted products, missed deadlines, expired medicines, regulatory penalties, or costs of substitute services, arising out of or in connection with your use of, or inability to use, Xpiry — even if the developer has been advised of the possibility of such damages.

To the fullest extent permitted by law, the developer's total aggregate liability arising out of or relating to Xpiry is limited to the greater of (a) the amount you actually paid for the app or its in-app purchases in the twelve months before the event giving rise to the claim, or (b) EUR 25.

These limitations do not apply to liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or to any other liability that cannot be limited or excluded under applicable law. Because some jurisdictions do not allow certain exclusions, parts of this section may not apply to you.

15. Changes to the service

Xpiry is actively developed. The developer may add, change, suspend or remove features, modules, export formats or integrations, and may release updates that change how the app behaves. Support for older Android versions or older app versions may end. A feature that depends on a third-party service may be withdrawn if that service becomes unavailable or changes its terms.

Where reasonably possible, significant changes will be described in the release notes on Google Play. Keeping the app updated is recommended; unsupported versions may stop functioning correctly.

16. Changes to these terms

These terms may be updated to reflect changes in the app or in the law. The "Last updated" date at the top of this page shows the current version, and the current version is always published at xpiry.net/terms. Continuing to use Xpiry after an update means you accept the revised terms. If you do not accept them, stop using the app and uninstall it.

17. Termination

You may end this agreement at any time by uninstalling the app. Since there is no account, nothing further is required; see section 16 of the Privacy Policy if you also want to remove a cloud backup.

The developer may terminate or suspend the licence granted in section 11 if you materially breach these terms — in particular the acceptable-use rules in section 9 — or where required by law or by Google Play policy. Sections 7, 8, 11, 13, 14 and 18 survive termination.

18. Governing law

These terms are governed by the laws of Romania and, where applicable, of the European Union, excluding conflict-of-law rules that would apply another jurisdiction's law. The courts of Romania have jurisdiction over disputes arising from these terms.

If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings in the courts of your own country. Before starting formal proceedings, please contact the developer — most issues are resolved by email.

If any provision of these terms is held invalid or unenforceable, that provision is limited or removed to the minimum extent necessary and the remaining provisions stay in force.
